Terms and Condition

Welcome to BiZZBoard Service Marketplace (“BiZZBoard,” “we,” “our,” “us”). By accessing or using our platform, you agree to be bound by these Terms and Conditions in accordance with EU law. If you do not agree, you must stop using the service.

Eligibility

  • Users must be at least 18 years old.
  • By creating an account, you confirm you have the legal capacity to enter into binding agreements under EU law.

Account Registration

  • You must provide accurate, complete, and up-to-date information.
  • You are responsible for all activity under your account.
  • BiZZBoard reserves the right to suspend or terminate accounts that violate EU consumer protection or platform rules.

Role of BiZZBoard

  • BiZZBoard is a digital intermediary that facilitates connections between freelancers (“Sellers”) and clients (“Buyers”).
  • BiZZBoard is not a party to contracts between Buyers and Sellers.
  • Contracts are legally binding between Buyers and Sellers under applicable EU contract law.

Payments & Fees

  • Payments are processed via licensed EU/EEA payment providers compliant with PSD2.
  • BiZZBoard charges a service fee per transaction (displayed before purchase).
  • Buyers must pay in advance; funds are released to Sellers once work is delivered and approved.

Cancellations & Refunds

  • Refunds are available under EU consumer protection law (e.g., right of withdrawal where applicable).
  • Exceptions may apply for digital goods once delivery has started with your consent.
  • BiZZBoard may intervene in disputes but final liability remains between Buyer and Seller.

Prohibited Activities

Users must not:

  • Use the platform for illegal activities under EU or Dutch law.
  • Circumvent payments or attempt off-platform transactions.
  • Post unlawful, defamatory, or misleading content.

Intellectual Property

  • Sellers retain IP rights until full payment is received.
  • Upon full payment, IP rights are transferred to Buyers unless explicitly agreed otherwise.
  • Users must respect EU copyright directives and third-party rights.

Limitation of Liability

  • BiZZBoard provides the platform “as is.”
  • To the maximum extent permitted by EU law, BiZZBoard is not liable for indirect damages, lost profits, or disputes between Buyers and Sellers.
  • Consumer rights under EU directives remain unaffected.

Data Protection

  • BiZZBoard processes personal data in compliance with the General Data Protection Regulation (GDPR – EU 2016/679).
  • Details are available in our Privacy Policy.

Termination

  • Accounts may be terminated for breach of these Terms or applicable EU laws.
  • Users may request account deletion at any time (Art. 17 GDPR).

Governing Law & Disputes

  • These Terms are governed by applicable EU law.
  • Disputes shall be subject to the jurisdiction of local courts, unless EU consumer protection rules allow otherwise.
